Terms and conditions

1. Duration and termination

Unless otherwise agreed, the contracts are concluded for the duration of a month, a quarter or a year. At the end of this period, the contracts will automatically renewed for a subsequent period of a month, a quarter or a year, unless one of the parties has notified the other by mail or letter at least seven days before the end of the period that they do not wish to renew the agreement.

2. Unauthorized use

The customer may in no way use the software provided to commit offenses or to cause damage or nuisance to Excelco bv or to third parties.

3. Intellectual property rights

All intellectual property rights in respect of software as well as designs, documentation and any other materials that are developed and/or used in the preparation or the execution of the agreement between the customer and Excelco bv, or arising therefrom, are held solely by Excelco bv. The provision of software does not entail any transfer of intellectual property rights.

The customer obtains a non-exclusive and non-transferable license to use the software for the agreed objectives.

4. Liability

Excelco bv strives to ensure that the information in its software is up-to-date, reliable and complete. Consultation and use of the software is done at the risk of the customer. Excelco bv does not warrant the correctness, completeness and accuracy of the information contained in its software, regardless of whether this information is collected by Excelco bv itself or provided by third parties.

The liability of Excelco bv is limited to the liability which is mandatory by law. If the liability of Excelco bv is retained, Excelco bv is only bound to refund price (per month, quarter or year).

5. Availability

Temporary delays or unavailability cannot give rise to any reimbursement of damages or other financial compensation.

6. Privacy

The data you provide will be included in the database of Excelco bv. These data will be used for the purpose of conducting information or promotional campaigns related to the products offered by Excelco bv.

Under no circumstances will these personal data be transferred to third parties. Excelco bv reserves the right to modify this privacy policy at any time in accordance with the law of 8 December 1992 on the protection of privacy and personal data.

7. Applicable law

These terms and conditions are governed by Belgian law. Any dispute will be arbitrated by the courts of Hasselt, Belgium only. This clause is an integral part of the terms and conditions and supersedes any conflicting jurisdictional clauses.
